A U.S. District Judge has ruled that Indiana must recognize a lesbian couple’s out-of-state marriage throughout their legal fight.
The ruling extends a preliminary injunction requiring the state to list Amy Sandler as the spouse of Niki Quasney on the death certificate after Quasney dies of cancer.
It is a ruling that only applies to this couple and not to any other.
The ruling does nothing to decide if Indiana’s gay marriage ban is unconstitutional.
The two women were married in Massachusetts last year after having been together for the past 13 years.
The attorney general’s office has expressed “its sympathy over the difficult medical situation the terminally ill plaintiff faces” but said state law does not allow for a hardship exception. The case is expected to eventually go before the US Supreme Court.
