Time is growing short for Atlas Excavating and the Terre Haute Sanitary District to reach an out-of-court settlement involving a dispute that dates back to 2009.
Atlas says that it ran into problems during a sewer project around the Woodgate subdivision south of town and that they incurred some large expenses because of that.
The company wants more than $1.6 million in damages from the city.
They say the city didn’t do proper pre project testing that would have avoided the problems.
If the two sides don’t reach a settlement, the case is set to go to trial in January and that could be very expensive for both sides.
