The developer of Cobblestone Crossings is suing the Vigo County Area Plan Commission. Southern Indiana Investments Co. says that Area Planning can not require them to build a wall between their apartment buildings and the Viscaya Point subdivision.
The company claims the wall is not a zoning requirement and it was arbitrary and that they are in compliance with all zoning requirements.
The attorney for the developer says that a wall built for the Woodgate subdivision was for another phase and that has nothing to do with this phase.
Members of Area Planning said that they believe that they can require the wall as a part of replating.
Regardless of how this plays out in the courts, one thing is for sure, the developers of Cobblestone won’t be thought of as good neighbors.
