A second mistrial in the Richard Boswell case.
Boswell is charged with the 1979 murder of Kathy Jo Baker and the attempted murder of her then two year old son.
The first trial was stopped because a witness on the stand made reference to Boswell’s criminal history.
That was evidence that was to be suppressed and not allowed to be presented during the trial.
That caused the first mistrial.
During closing arguments today an attorney on the prosecution team made reference to Boswell's prior criminal history outside the Baker case.
The defense asked for a mistrial, which was granted.
Boswell has now been released.
Vigo County Prosecutor Terry Modesitt said his office plans to file paperwork for a third trial.
