The attorney for a man being sued in the disappearance of IndianaUniversity student Lauren Spierer wants the case dismissed.
Michael Beth is being accused by the parents of Spierer of being responsible for her death.
He is believed have been the last person with her before her disappearance.
He faces no criminal charges in connection with Spierer’s disappearance.
Beth’s attorney is Greg Garrison and he said that just because Spierer has been missing for two years it doesn’t prove that she is dead or that his client has anything to do with her disappearance.
Indiana law requires a person to be "inexplicably absent for a continuous period of seven years" to be presumed dead. Spierer has been missing since June 2011.
Beth claims he tried to get her to sleep on his couch that night and when she refused, he escorted her to another man's apartment.
