Police say that 23-year-old Ardis Fenn is charged with aggravated battery with a firearm in another shooting last June.

The reason for the mistrial is that witness Curtis Mosely was shot to death Monday in Urbana.

The next day Fenn did not appear for the scheduled start of his trial, but later surrendered to police.

A new trial with a new jury is set to start next week.
