DCS May Be Slowing Abuse Investigation


The state agency that may have approved a Terre Haute couple’s adoption of four children who were allegedly abused is trying to throw up a road block in the investigation.


Larry and Nikki Russell were arrested in late November after one of their adopted children escaped the family’s North 12th Street home and sought help for his siblings.


Police say that the 17-year-old boy and his siblings showed obvious signs of abuse.


Vigo County Prosecutor Terry Modesitt obtained search warrants to obtain records on the Russell’s and any children who may have been placed in their care.


Now the Indiana Department of Child Services filed a motion on Wednesday challenging the warrants and asking that they be recalled.


DCS has suggested that they first be allowed to provide the requested documents to the judge for confidential review.


Judge Roach set a Jan. 25 hearing on the request to throw out the warrant.


A DCS spokesperson told the Tribune-Star that DCS will comply with the warrant but that the motion was filed as standard procedure so that DCS is “on the record” as complying with state and federal confidentiality laws. Both Larry and Nikki Russell remain in the Vigo County Jail with bail set at $100,000 cash only.
