BATTLE CREEK (WTVB) - The Michigan Court of Appeals has ruled that Tom Foley deserves a new trial for his first degree murder conviction in the shotgun slaying of his wife two years ago at the couple’s home in Branch County’s Girard Township. The new trial was ordered by Calhoun County Circuit Judge Conrad Sindt, who presided over the case in Coldwater.
Branch County prosecutor Terri Norris appealed Sindt’s order to the Court of Appeals. Norris today said her office will now appeal the re-trial order to the Michigan Supreme Court.
